Speaking Point: 1) On November 2, 2010, California voters will decide if persons age 21 or older may possess up to one (1) ounce of marijuana for personal consumption, use marijuana home or a licensed public establishment, and/or grow marijuana at home for personal consumption. Speaking Point: 2) What's in it for me (California)? Well, Prop. 19 will also allow local governments to regulate these marijuana activities, impose marijuana-related fees and taxes and authorize various criminal and civil penalties. So, a proposed $50 per ounce levy may generate an estimated $1.4 billion in annual tax revenue. Speaking Point: 3) Will Prop. 19 solve California's financial woes or let more criminals out on the streets? Speaking Point: 4) Don't plant your marijuana seeds just yet! Prop. 19 legalizes marijuana under California law but not Federal Law. Speaking Point: 5) California Law v. Federal Law: Is there Federal preemption under the "Controlled Substances Act?" Speaking Point: 6) Hypothetical: You grow your own weed at your California home. And, you want to travel to Las Vegas and have a great time so you bring an ounce of weed on your trip. While cruising the Las Vegas strip, a policeman pulls you over and searches your car. Subsequently, you are arrested for the illegal possession of a controlled substance. Are you protected under the new law? The answer is NO! Prop. 19 does not allow interstate or international transportation of marijuana and any offenders will likely be criminally prosecuted under Federal Laws. Speaking Point: 7) In Support: Rep.
